Ticketing Terms and Conditions
Beauty Media Collective Pty Ltd (‘BMC’) and/or BMC’s organisational representative and principal Anna Whittingham (‘we’, ‘us’, ‘our’), may offer tickets to events they hold such as BEAUTY, BUT MAKE IT BUSINESS.
General Terms and Conditions
Please read these Terms and Conditions carefully before purchasing a ticket. You should not purchase a ticket unless you are 18 years of age or older and understand and agree to these Terms and Conditions. If you have any questions, please let us know.
By purchasing a ticket from us (including through any third-party ticketing platform), you agree to be bound by these Terms and Conditions. Where a third-party ticketing platform is used, purchases are also subject to the Terms and Conditions of such ticketing website. BMC has no responsibility nor does BMC make or give any warranty or representation regarding the platform or activities of any third-party ticketing service. You should always check the security of such a platform before entering any financial or personal information.
These Terms and Conditions relate to both the sale of tickets and attendance at BMC events and apply to both the original purchaser and any subsequent ticketholders (you).
BMC may vary these Terms and Conditions at any time by updating them. Any variations will only apply to ticket purchases made after the Terms and Conditions have been updated.
BMC reserves the right to re-schedule any event. BMC will accept your ticket at the re-scheduled date of the event or provide a refund inclusive of any booking fee (subject to any third-party ticketing platform’s Terms and Conditions). A refund should be requested within the time frame set out in our Refund terms below and must be made in writing. If you do not seek a refund in this period, BMC may decline to provide you with a refund (in its absolute discretion).
If an event is cancelled BMC will offer you a full refund inclusive of any booking fee (subject to any third-party ticketing platform’s Terms and Conditions) unless cancellation is due to circumstances beyond the reasonable control of BMC, in which case we reserve the right to retain a reasonable portion of the fees you have paid to cover our unavoidable costs.
BMC reserves the right to vary the content of any advertised program, prices, venue, seating arrangements (including ticket categories) and audience capacity, but will always ensure that the event is of a high standard.
Tickets will be delivered via the email address provided during purchase. This confirmation email may be requested before entry to the event is permitted.
When purchasing tickets for an event you may be limited to a specific number of tickets. If our platform allows you to exceed the stated ticket limit due to a technical error, you may have any or all of your orders and tickets cancelled (and refunded less any unavoidable ticketing fees charged to us by a third party provider) without notice by BMC at its discretion. This includes orders associated with the same name, e-mail address, billing address, credit card number or other information. Ticket limits apply to ensure fair access to tickets.
You are responsible for the tickets purchased and no liability or refund may be obtained for tickets lost, stolen or forgotten.
Copyright in the material used and disseminated in the conduct of an event by BMC is and remains the property of BMC and/or the presenters and panellists, and all rights are reserved in accordance with the provisions of the Copyright Act 1968 (Cth) (each a Copyright Work). The Copyright Works made available to you in connection with any event are for your personal use only. You may not copy, distribute, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any content, materials or products provided to you by BMC unless expressly authorised by law. You agree to not offer, or make available to third parties, products made available to you by BMC, or developed, adapted, modified from or created using or by reference to our Copyright Works, whether or not you do so for financial reward.
Additionally, you agree that you will not create, attempt to create, or assist others to create or attempt to create, a product that competes with our service offerings by reference to our Copyright Works.
BMC events, including but not limited to BEAUTY, BUT MAKE IT BUSINESS, may include confronting content. No psychological assessment is conducted prior to attendance and no aftercare is provided for any emotional damage suffered following our events.
Before you attend one of our events you, you should seek medical or psychological advice from a suitably qualified person as to the appropriateness of BMC events for you. You acknowledge that attendance may be triggering for some participants and agree to seek the support of a mental health care professional if you are affected by the content provided. To the extent permitted by law, BMC do not accept any liability of any kind, whether in contract, tort or otherwise, for any act, omission or default through negligence or other means, of third parties over whom BMC have no direct control. Under circumstances where liability cannot be excluded, the liability is limited to the value of the purchased ticket. No claim in contract, tort or otherwise can be made by you for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond the reasonable control of BMC.
To the extent permitted by law, you agree that in no circumstance will BMC be liable to you for indirect loss, loss of profits, loss of opportunity or loss of enjoyment.
The term “including” when used in these Terms and Conditions is not a term of limitation.
The laws of Victoria apply.
Conditions of Entry
Tickets are proof of purchase and must be presented at the time of admission to an event. Tickets are non-transferable and only one person is permitted entry per ticket purchased unless otherwise agreed by BMC.
Entry to an event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way or has not been purchased from BMC or other authorised ticketing platform.
Admission to an event is subject to the following terms:
You may be denied entry into, or removed from, an event where BMC has reasonable grounds to do so, including if you:
breach these Terms and Conditions;
are intoxicated or under the influence of illicit drugs;
are inappropriately attired;
behave in a harassing, threatening, abusive, disruptive or inappropriate manner; or
behave in a way that adversely affects the enjoyment of the event by others.
If you are denied entry or removed from an event you will not be eligible for a refund.
If you arrive late you may not be admitted until a suitable break in the event.
You are not permitted to take into the event, or use, cameras or other recording equipment (including mobile phones) unless otherwise advised.
You may be required to submit to a search of your person and/or possessions before entering the event.
By attending the event, you and each attendee in your group acknowledge and agree that you may be filmed and/or recorded, and you give permission to BMC to use your image, likeness and voice obtained at the event to promote or explain our services to the public. If you provide any written comments or feedback on BMC to us, you grant us a perpetual, irrevocable, royalty-free, world-wide, assignable and sub-licenceable licence to use that content for any purpose.
You agree to comply with all Government directions, orders and regulations relevant to attending live events, which may be in place at the time of the event.
When attending the event, you and each attendee in your group agree to assume all risks associated with COVID-19 or other such communicable diseases, and to follow all relevant policies and procedures we make known to you.
By attending an event, you agree to be bound by any conditions of entry, code of conduct or other rules imposed by the venue at which an event is being held.
During your participation in BMC’s events, you may disclose information about yourself, or learn of information about other participants. When this happens, you agree that:
It is a condition of participation in our events that you keep that information confidential and do not share it outside of the BMC event; and
Despite this being a condition of participation, BMC cannot guarantee that your information will be kept confidential, and to the extent permitted by law you release us from any liability arising from another participant disclosing information about you to a third party.
Privacy and Marketing Consent
The purchaser expressly consents to BMC collecting, using and disclosing the purchaser's personal information, including their name, email address, telephone number and other contact details, to the Event's sponsors, partners and exhibitors for the purposes of advertising, promoting and marketing their products, services, events and other commercial offerings.
The purchaser further consents to receiving direct marketing communications from the Event Organiser and the Event's sponsors, partners and exhibitors by email, SMS, telephone or other lawful means. The purchaser acknowledges that such communications may include promotional offers, newsletters, invitations, surveys and other marketing material. The purchaser may opt out of receiving direct marketing communications from the relevant sender at any time using the unsubscribe or opt-out mechanism provided in the communication or by otherwise notifying the sender.
Refunds
BMC offers the following refunds for change of mind or change in personal circumstances:
up to 7 days prior to the event – 100% of ticket price paid;
less than 7 days prior to the event – 50% of ticket price paid.
Unless otherwise stated, BMC does not offer refunds or exchanges as a result of a change in your personal circumstances on the day of the event or due to external factors such as, for example, adverse weather, illness, injury or bereavement.
BMC will only offer a refund if an event is cancelled, rescheduled or significantly relocated (and you cannot or do not wish to attend the rescheduled or relocated event), or to the extent otherwise required by law. If an event is rescheduled or relocated you must apply for a refund in writing by the earlier of:
4 weeks after notification of the reschedule or relocation; or
72 hours prior to the event.
If you do not request a refund by that date, you will be deemed to have agreed to having your ticket transferred to the rescheduled or relocated event, and will not be entitled to claim a refund.
If an event is cancelled, rescheduled or significantly relocated by BMC, all liability is limited to the amount for which the ticket was purchased (including any fee or charges unless otherwise notified at the time of purchase). Proof of purchase may be required for any refund. Unless required by law, BMC will not be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including but not limited to any travel and accommodation expenses. You should carefully consider the refund and cancellation policies of travel, accommodation and other goods or service providers when making arrangements for attendance at an event. You may also wish to consider taking out a relevant insurance policy to cover for any losses in the event of cancellation, rescheduling or relocation.
Tickets may not, without the prior written consent of BMC (and any authorised third-party ticketing platform) be resold or offered for resale at a premium or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the ticketholder may be refused admission.
Note: the resale of tickets in certain circumstances is considered ticket scalping that is governed by ticket sales legislation and may attract criminal penalties.
